Rear-End Collisions – Is The Rear Car Always Wrong?

In Louisiana when a rear-end collision occurs the law actually provides a presumption that the rear, or ‘following’, motorist was negligent. A. The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicle and the traffic upon and the condition of the highway.
