Using Your Own UM Coverage In A Commercial Vehicle Accident

Insurance policy issues in LouisianaIf you have UM coverage, you can pursue your own insurance company for any damages for which the commercial vehicle liability policy does not provide coverage.  In other words, if the company issued liability policy has limits of $100,000.00, and you have sustained serious injuries totaling more than $100,000.00, you will receive the first $100,000.00 of your settlement from the commercial vehicle insurance company (assuming the company vehicle to be at fault).  Once their insurance limit is reached, you can then pursue your own UM insurance coverage for the remaining damages up to the limits of your UM policy.  The fact that the accident was caused by a commercial vehicle does not in any way prevent you from collecting your own UM insurance proceeds if necessary.
